The man accused of fatally shooting Charlie Kirk will stand trial after a judge determined there is enough evidence for the case to proceed.

After hearing closing arguments from the prosecution and defense at a probable cause hearing on Tuesday, Sept. 1, Fourth District Judge Tony Graf ruled that prosecutors established sufficient probable cause on multiple charges, including aggravated murder, obstruction of justice, and felony discharge of a firearm causing serious bodily injury.

If convicted of aggravated murder, Robinson could face the death penalty.

The 31-year-old conservative political activist was killed nearly a year ago, on Sept. 10, 2025, during a Turning Point USA rally at Utah Valley University in Orem.

Prosecutors with the Utah County Attorney’s Office allege that Robinson, 23, fired one shot from a high-powered rifle from the rooftop of a nearby building while Kirk addressed a massive crowd.

The bullet, fired from about 140 yards away, FOX 29 reported, struck Kirk in the neck, killing him instantly.

After a highly publicized manhunt, Robinson, who was living in St. George at the time of the shooting, turned himself in the next day.

Robinson was charged with seven counts including aggravated murder, a capital offense.

On Tuesday, prosecutors and attorneys for Robinson each had four hours to present their arguments.

The prosecution cited multiple pieces of evidence, including video of the shooting, DNA evidence, and clothing obtained from Robinson, that it argued were sufficient to move ahead to trial.

The defense, meanwhile, disputed that Robinson targeted Kirk for his political beliefs, and described the prosecution’s arguments as speculative. Robinson’s attorneys also argued that the prosecution did not provide enough evidence to establish that others were at risk at the time of Kirk’s shooting, and that the evidence did not support an aggravated murder charge.

Robinson has not yet entered a plea.

The hearing came after an initial five-day preliminary hearing in July when prosecutors argued that Robinson should stand trial for Kirk’s murder and defense attorneys argued against it.

Afterward, the judge granted a defense motion for both sides to file briefs summarizing their arguments and scheduled the hearing for their closing arguments on Sept. 1.

As PEOPLE previously reported, prosecutors claimed in their filing that Robinson confessed to killing Charlie Kirk in at least 11 separate written messages and that Robinson targeted Kirk due to the conservative activist’s views, particularly on LGBTQ+ rights.

At the time, he was in a same-sex relationship with  Lance Twiggs, whom he “loved and cared deeply for,” according to the memorandum.

“I had the opportunity to take out Charlie Kirk, and I took it,” Robinson allegedly wrote to Twiggs.

Defense lawyers questioned the reliability of the prosecution’s DNA evidence, the Associated Press and ABC 7 reported.
