WHAT HAPPENS IF LINDSAY CLANCY IS FOUND NOT GUILTY?

As the jury continues deliberating in the Lindsay Clancy trial, one question is drawing increasing attention:

What would actually happen if Clancy were found not guilty?

The jury has not reached a verdict yet, and deliberations are expected to continue.

A NOT-GUILTY VERDICT WOULD BE SIGNIFICANT

If the jury returns a straightforward not-guilty verdict, Clancy would be acquitted of the charges covered by that verdict.

Under the constitutional protection against double jeopardy, prosecutors generally cannot simply put her on trial again for the same offenses after an acquittal.

That would bring the criminal prosecution for those charges to an end.

BUT THERE IS ANOTHER POSSIBLE OUTCOME

One of the most important distinctions in this case is between “not guilty” and “not guilty by reason of insanity.”

Clancy’s defense has argued that she was suffering from severe postpartum psychosis when her three children died in January 2023.

The prosecution, however, has argued that although Clancy was experiencing serious mental-health problems, she remained criminally responsible for her actions.

If jurors find her not guilty by reason of insanity, that does not necessarily mean she simply walks out of court.

Instead, she could be committed to a psychiatric facility under Massachusetts law, potentially for an extended period.

THE JURY HAS FIVE POSSIBLE VERDICTS

Jurors were instructed that they could reach different verdicts on each of the three children, including not guilty, not guilty by reason of insanity and guilty of different degrees of the charges.

That means the final outcome could be far more complicated than a simple guilty-or-not-guilty decision.

FOR NOW, THERE IS NO VERDICT

The jury began deliberations on August 27 and had still not reached a decision by the end of August 28. Jurors are scheduled to continue deliberating.

So, for now, Lindsay Clancy has not been found guilty or not guilty.

The final decision rests with the jury.

And whatever verdict comes back could determine whether Clancy faces a life sentence, psychiatric confinement, or acquittal on the charges.
