ROCHESTER, N.Y. — A mother who reconnected with her developmentally disabled son decades after losing custody of him is now facing a murder charge after authorities found the 33-year-old dead inside his Rochester apartment, severely malnourished and with signs of physical restraint, police allege.

Timothy Green, 33, was found dead on February 17, 2026, after officers were called to an apartment near St. Paul and Andrews streets in Rochester to investigate a report of an unresponsive man.

What investigators discovered inside the apartment has now led to criminal charges against Timothy’s mother, Andrea Livers, 58, and her boyfriend, Lancysa Harris, 42.

Both were arrested on September 15 and charged after an indictment was unsealed the following day, according to Rochester police and court records reported by PEOPLE.

TIMOTHY WAS FOUND SEVERELY MALNOURISHED

When first responders entered the apartment, they found Timothy on the living room floor.

He was unclothed, covered in bruises and appeared severely malnourished and emaciated, according to Rochester Police Capt. Frank Umbrino.

Police said Timothy weighed only 88 pounds when he was found.

Investigators also observed marks around his wrists and ankles that authorities say were consistent with restraints.

Police allege Timothy had been physically restrained using handcuffs and home-gym weights.

Authorities have described the circumstances surrounding his death as deeply disturbing and say the investigation uncovered evidence that he had allegedly been deprived of adequate food and subjected to prolonged abuse.

MOTHER AND BOYFRIEND WERE INSIDE THE APARTMENT

Livers and Harris were reportedly inside the apartment when emergency responders arrived.

According to police, the couple told authorities that they had called 911 after finding Timothy unresponsive.

But investigators said their explanation for his condition did not make sense.

Police said the pair subsequently became uncooperative and declined to answer questions about what had happened.

Investigators continued examining the apartment and the circumstances surrounding Timothy’s death.

The allegations later became the basis for a sealed indictment warrant that led to the arrests of Livers and Harris in September.

According to the investigation, Timothy had a developmental disability and had been separated from his mother for many years after she lost custody of him.

The two eventually reconnected as adults.

Authorities allege that Livers and Harris took control of Timothy’s SNAP benefits, using the money for their own benefit while withholding food from him.

Police say the alleged abuse occurred between approximately January 19 and February 17, 2026, the day Timothy was found dead.

POLICE ALLEGE TIMOTHY WAS RESTRAINED

Investigators have also alleged that Timothy was restrained before his death.

According to Rochester police, officers found evidence of restraint marks on his wrists and ankles.

Authorities further allege that handcuffs and home-gym weights were used to restrict his movement.

The investigation is continuing as prosecutors build their case against Livers and Harris.

BOTH SUSPECTS FACE SERIOUS CHARGES

After the indictment was unsealed on September 16, Livers and Harris were charged with:

The charges relate specifically to Timothy Green, according to Rochester police.

Both defendants are presumed innocent unless and until they are proven guilty in court.
