However, courts have previously rejected Howard’s claims that his mental condition makes him constitutionally ineligible for execution.

The Fifth Circuit’s October 5 ruling specifically addressed his renewed intellectual-disability argument and declined to halt the execution.

Howard was convicted in connection with the May 12, 2000, killing of Vickie Swartout, a gas-station employee in Silsbee, Texas.
