Lindsay Clancy Trial: Judge Orders Jury to Ignore Religion Remark After Mistrial Request

The Lindsay Clancy murder trial took a dramatic turn on August 25 when a prosecution rebuttal witness mentioned religion while discussing Clancy’s mental state, prompting the defense to request a mistrial.

Dr. Kirk Heilbrun, a forensic psychologist and prosecution rebuttal witness, testified about Clancy’s reported mental state. He said Clancy had described hearing a male voice that she believed was commanding her to kill her children.

During his testimony, Heilbrun also referenced Clancy’s Catholic upbringing and the religious concept of “mortal sin” in connection with suicide.

Defense attorney Kevin Reddington immediately moved for a mistrial, arguing that bringing religion into the testimony was inappropriate and could unfairly influence the jury.

Judge William Sullivan denied the mistrial request, but criticized the religious reference and instructed jurors to disregard that portion of Heilbrun’s testimony.

The judge’s instruction allowed the trial to continue, with proceedings resuming on August 25.

The incident adds another contentious moment to a trial centered heavily on competing psychiatric assessments of Clancy’s mental state and whether she should be held criminally responsible for the deaths of her three children.
