LUCY LETBY CASE: CPS UPHOLDS DECISION NOT TO BRING FURTHER CHARGES OVER SIX BABIES

MANCHESTER, England — A major development in the Lucy Letby case has closed another potential path to prosecution after the Crown Prosecution Service (CPS) upheld its decision not to bring additional charges involving six babies.

The review was requested by the families of the six infants under the Victims’ Right to Review process after the CPS previously decided that no further criminal charges should be brought against Letby.

According to the CPS, an independent prosecutor conducted an extensive review of the evidence and reconsidered six allegations of attempted murder involving the babies. The review ultimately upheld the original decision not to prosecute.

SIX CASES RECONSIDERED

The latest review follows a broader examination of allegations involving babies treated at the Countess of Chester Hospital and Liverpool Women’s Hospital, where Letby worked during her nursing career.

In January 2026, prosecutors announced that they would not bring additional charges after reviewing evidence concerning further allegations.

Families connected to six of those cases subsequently asked the CPS to reconsider the decision.

The independent review has now concluded that the evidential threshold for additional charges was not met, leaving the original decision in place.

LETBY’S EXISTING CONVICTIONS REMAIN IN PLACE

The decision does not overturn or alter Letby’s existing convictions.

Letby was convicted of murdering seven babies and attempting to murder six others in her original trial. She received multiple whole-life sentences and remains imprisoned.

She was also convicted in 2024 of attempting to murder another infant after a retrial on one charge on which the original jury had been unable to reach a verdict.

The latest CPS decision concerns potential additional charges, not the convictions that have already been secured.

CPS SAYS FAMILIES WILL RECEIVE FURTHER EXPLANATIONS

The CPS said it has written to the families involved and will offer meetings to answer their questions about the review.

For the families, however, the decision marks another difficult moment after years of investigations and legal proceedings.

The CPS said the independent prosecutor’s review involved a re-examination of substantial evidence and material before reaching its conclusion.

Although no new charges will be brought over these six cases, the wider Letby story continues to generate intense public and legal scrutiny.

Letby’s defense team has continued to challenge aspects of the evidence used to convict her, while the Thirlwall Inquiry has examined the circumstances surrounding the deaths and collapses of babies at the Countess of Chester Hospital.

The Criminal Cases Review Commission is also considering material relating to Letby’s convictions.

Those developments are separate from the CPS decision announced this month.
