A Connecticut man is facing criminal charges after allegedly leaving his son in a hot car while he was working on the family’s strawberry farm.

Kevin Pell, 47, is charged with risk of injury to a child after his 1-year-old son died on Aug. 15 in Broad Brook, a town located approximately 20 miles north of Hartford.

A call was made by the father to emergency dispatch at 2:25 p.m. that day, saying he had left the boy in the car because he was sleeping and returned to find the child “blue and not breathing,” according to the East Windsor Police Department (EWPD).

Pell was taken into custody but later released after posting bail, which was set at $1 million.

New details about the child’s death are now being revealed in a search warrant obtained by PEOPLE, including that Pell allegedly told the emergency dispatcher that he “didn’t have the AC on” when he left his son in the vehicle.

However, once officers arrived on the scene, Pell said the child was left in the vehicle with the air conditioning on because he was asleep, according to the warrant.

Officers said that the vehicle was parked directly in the sun with the sunroof and windows closed, making it “not habitable for the child,” per the warrant.

The infant was rushed to a local children’s hospital from the scene where he was declared dead shortly after arrival.

Pell may be facing additional charges, as the investigation into the incident is ongoing and autopsy results for the child are still pending.

As a condition of his bail, Pell is not allowed to be alone and unsupervised with any individual under the age of 18, including his other child.

He appeared in Hartford Superior Court on Thursday, Sept. 10, but did not enter a plea.

Pell is expected back in court on Oct. 16. His attorneys did not respond to PEOPLE’s request for comment.
