A New Jersey hospital has reportedly settled a $15 million case with the family of a man who claims he was discharged in the middle of an asthma attack, which led to his death.A lifelong asthmatic, Jerome White, 35, arrived to Cooper University Hospital in Camden on June 3, 2020, seeking treatment. He was seen and let go, despite “screaming that he could not breathe,” per a report from NJ.com. When he was discovered outside the hospital by police officers, they documented that ER staff said White “comes here all the time and pretends to be sick,” per the outlet.

White’s condition continued to deteriorate, and he collapsed on the ground, his lips turning blue, per a police report obtained by NJ.com. He was finally brought back inside the hospital, where he died on June 19. His cause of death was anoxic encephalopathy — “brain damage due to decreased oxygen,” per the National Library of Medicine  — and cardiac arrest, per NJ.com, which says that his death certificate also listed his severe asthma as a cause.

After White’s family threatened a lawsuit against Cooper University Hospital and Camden County, the outlet says, a confidential $15 million settlement was reached.

A representative for Cooper University told PEOPLE in an emailed statement that, “We respect the confidentiality clause of the settlement agreement sought by both parties and, therefore, have nothing to add.”

The reported $15 million settlement with the hospital and Camden County allegedly allowed for a trust to be established for White’s son, who was 14 years old at the time of his death.
