The Unbelievable Irish Court Case Where a Single Photo Collapsed an $820,000 Injury Claim

In February 2017, Kamila Grabska, a 36-year-old mother of two from County Clare, Ireland, was involved in a car accident. She subsequently filed a personal injury lawsuit against RSA Insurance worth over €760,000 (roughly $820,000), claiming the crash left her with agonizing, constant pain in her neck, back, and spine. She maintained that basic tasks—like lifting a heavy bag of groceries or playing with her children—caused intense pain, often leaving her bedridden for half the day. Citing a permanent inability to work, her claim relied heavily on severe physical limitations.

However, the defense uncovered evidence that completely contradicted her claims. In January 2018, less than a year after the crash, Grabska entered the local Christmas tree throwing competition. The event challenged contestants to launch a five-foot spruce tree as far as possible. Not only did she compete, but she also won the women’s division. A photograph published in a national newspaper captured her throwing the large tree with remarkable agility. Devastatingly for her case, just two days after the photo was published, she told a doctor she was in constant pain and could not lift heavy objects.

During the High Court trial in Ireland, the defense presented both the newspaper photograph and video footage from late 2023 showing her playing dynamically with her dog in a park for 90 minutes. Although Grabska denied faking her condition, Judge Carmel Stewart concluded that her actions directly disproved the severe limitations she described. The judge dismissed the entire lawsuit, ruling that her claims were entirely exaggerated. In a case centered on what she was allegedly unable to lift, it was the heavy Christmas tree she threw that ultimately brought her multi-hundred-thousand-euro claim crashing down.
