The Florida man convicted of killing Kristine Melton and Diane Ruiz is continuing his legal fight against the death sentences imposed for the two 2019 killings.
Wade Wilson remains on Florida’s death row — but despite renewed public attention surrounding his case, there is currently no official execution date.
Wilson was sentenced to death in 2024 after being convicted of killing 35-year-old Kristine Melton and 43-year-old Diane Ruiz in Cape Coral, Florida, in 2019.
His case has continued through the appeals process, meaning the death sentences have not yet reached the point where an execution can be scheduled.
THE LATEST LEGAL FIGHT
Wilson’s attorneys challenged the constitutionality of Florida’s death-penalty law, specifically the change that allows a jury to recommend death without a unanimous vote.
In Wilson’s case, jurors voted 9–3 in favor of death for Melton’s murder and 10–2 for Ruiz’s murder.
Florida’s 2023 law permits a death recommendation when at least eight of 12 jurors support it.
At a Florida Supreme Court hearing in February 2026, Wilson’s attorney did not reargue the constitutional issue, acknowledging that the court had already upheld the relevant law in other cases.
Instead, his lawyer said the arguments were being preserved for a possible appeal to the U.S. Supreme Court.
The Florida Supreme Court upheld the lower court’s ruling.
NO EXECUTION DATE YET
Despite social-media claims suggesting that Wilson could soon face execution, available reporting indicates that no execution date has been officially scheduled.
Wilson remains incarcerated at Union Correctional Institution in Raiford, Florida, which houses the state’s male death-row prisoners.
