86-YEAR-OLD GRANDFATHER DIED AFTER BURGLAR HEADBUTTED HIM DURING HOME RAID — ATTACKER JAILED FOR 18 YEARS
An 86-year-old pensioner died after being headbutted by a burglar who broke into his home while his 91-year-old wife was inside.
Ashley Malcolm, 40, has now been jailed for 18 years, with a further five years on extended licence, after pleading guilty to manslaughter and several other offences.
The case has left John Burke’s family mourning a man they described as quiet, hardworking and devoted to his wife.
JOHN BURKE WAS ATTACKED INSIDE HIS OWN HOME
John Burke, a retired plumber, was at his home in Hackney, east London, with his wife Peggy when Malcolm broke in during the early hours of September 29, 2025.
The burglary lasted for a prolonged period.
When Burke confronted the intruder, Malcolm headbutted him.
The blow fractured Burke’s nose and caused bleeding on the brain.
He was taken to hospital later that morning but was discharged several hours afterward.
The following day, his son Sean found him unconscious on the floor of his bedroom.
Further medical tests revealed a “devastating and irreversible” brain injury, and Burke later died.
HIS FAMILY BELIEVE HE WAS PROTECTING HIS WIFE
Burke’s grandson, Reece Lambert, told the court that he believed his grandfather had been attacked while trying to protect Peggy, his wife of many decades.
He described John as a quiet and stoic man with a strong sense of humour who loved his wife deeply.
His son Sean said his father was a “quiet, hard-working, easy-going man” who had never been someone to hold a grudge.
He said his parents did not have much of material value in their home.
“They had each other,” he said.
MALCOLM HAD A LONG HISTORY OF BURGLARY
The court heard that Malcolm had an extensive criminal record.
He had 12 previous convictions for burglary and attempted burglary over a period of about 20 years, as well as convictions for assault.
After breaking into the Burkes’ home, Malcolm continued his offending.
Within hours, he broke into a care home and attempted to burgle another flat while people were inside.
He also admitted possessing cocaine.
Malcolm initially faced a murder charge and denied murder, but later pleaded guilty to the lesser offence of manslaughter during his trial.
THE JUDGE’S SENTENCE
At the Old Bailey, Judge Simon Mayo KC said Malcolm had targeted “two elderly and vulnerable” people and described the burglary as prolonged.
The judge said the headbutt caused the injuries from which Burke died.
Malcolm was sentenced to 23 years in total — 18 years in prison followed by five years on extended licence.
The judge said the sentence reflected his other offending as well as the manslaughter.
Malcolm’s defence lawyer referred to a statement in which he said he was sorry to the Burke family and described what happened as an accident.
A FAMILY LEFT WITH AN “IMMEASURABLE” LOSS
The court heard how deeply Burke’s death had affected his family.
His son said he would never forget finding his father unconscious at home.
He said his father had deserved to die peacefully after a life of hard work, respect and kindness.
For the Burke family, the tragedy began with a burglary but ended with the loss of an 86-year-old husband, father and grandfather.
John Burke had survived decades of life with the woman he loved.
In the early hours of that September morning, his family believes he was simply trying to protect her.
Now, more than a year after the attack, the man responsible has been sentenced to prison — while Burke’s family continues to live with his absence.
