NOLAN WELLS’ PHONE STILL HASN’T BEEN FORENSICALLY EXAMINED — AND NOW LAWYERS AND PROSECUTORS ARE CLASHING
More than a month after 18-year-old Nolan Wells was found dead near Horn Island, one potentially important piece of evidence remains at the center of a growing dispute:
His cellphone.
The device has still not undergone the forensic examination that Nolan’s family believes could help clarify his final hours.
WHY HASN’T THE PHONE BEEN EXAMINED?
According to the family’s attorneys, the two sides had already discussed a joint forensic examination during a July 15 meeting.
The proposed process would involve the Digital Forensics Lab at Mississippi Gulf Coast Community College, with possible FBI participation.
But no date or time for that examination was ultimately set.
The family says the parties also never reached agreement on important issues such as the examination protocol, chain of custody, preservation of extracted data and access to the results.
THEN CAME THE DEADLINE
On August 12, the district attorney’s office reportedly instructed the family to deliver Nolan’s phone by 9 a.m. on August 14.
The family’s attorneys say that gave them less than 48 hours to comply.
They also said Nolan’s parents were outside Mississippi when the request was sent and were not scheduled to return before the deadline.
That is where the “out of town” explanation comes from.
But the family’s lawyers strongly dispute the suggestion that they are refusing to cooperate.
TWO VERY DIFFERENT VERSIONS OF THE DISPUTE
The DA’s demand was for the phone to be delivered to law enforcement.
The family says that was not what they understood had been agreed upon during the earlier meeting.
Their position is that the phone should undergo a jointly controlled forensic examination involving both official and outside experts.
The legal team has said it remains ready to arrange the examination once an acceptable protocol is established.
WHAT COULD THE PHONE REVEAL?
The device could potentially contain information relevant to Nolan’s timeline, including digital records that might help investigators reconstruct his movements and communications.
His family has previously raised questions about why Nolan’s phone was separated from him when he disappeared from Horn Island.
Those questions have become even more significant because the circumstances of his death remain unresolved.
However, it is important not to claim that the phone definitely contains “game-changing evidence.”
Nobody knows what a forensic examination will actually reveal until it is conducted.
THE BIGGER MYSTERY
Nolan traveled to Horn Island with friends for a Fourth of July gathering.
He did not return with the group.
His body was found in the water on July 6.
Authorities initially suspected drowning, but his family has continued to question the circumstances surrounding his death, and the cause remains under investigation.
Now another question has emerged:
Why has Nolan’s phone still not been examined more than a month after his death?
The family says they want answers.
The DA wants access to the device.
And lawyers on both sides are now arguing over how that access should happen.
THE PHONE HAS BEEN RECOVERED.
THE FORENSIC EXAMINATION HAS NOT YET HAPPENED.
A DEADLINE WAS SET — AND THE FAMILY DID NOT MEET IT.
BUT THE FAMILY’S LAWYERS SAY THEY HAVE NOT REFUSED TO COOPERATE.
AND NOLAN’S DEATH STILL HAS NO DEFINITIVE PUBLIC EXPLANATION.
The phone may ultimately provide important answers.
But first, someone has to agree on how it will be examined.
