WADE WILSON REMAINS ON DEATH ROW — BUT HIS LEGAL FIGHT IS FAR FROM OVER
AFTER TWO DEATH SENTENCES, WILSON’S ATTORNEYS ARE TAKING THEIR CHALLENGE TO THE NEXT LEVEL
Wade Wilson remains on Florida’s death row after being sentenced to death for the 2019 murders of Kristine Melton, 35, and Diane Ruiz, 43.
But his case is not over.
Wilson’s attorneys are continuing to challenge the legality of his death sentences, arguing that Florida’s newer death-penalty rules were improperly applied to his case.
Wilson was convicted of two counts of first-degree murder in June 2024. The following month, a jury recommended death in both cases.
THE JURY VOTES ARE NOW AT THE CENTER OF THE APPEAL
The jury voted 9–3 in favor of a death sentence for Melton’s murder and 10–2 for Ruiz’s murder.
The issue stems from a change Florida made to its death-penalty law in 2023.
Under the newer law, a death recommendation does not require a unanimous jury. A minimum 8–4 vote is sufficient for a judge to impose a death sentence.
Wilson’s lawyers argue that applying the revised law to murders committed in 2019 raises constitutional questions.
HIS CONVICTIONS ARE NOT THE CURRENT TARGET OF THE APPEAL
According to Court TV, Wilson is not appealing his murder convictions themselves.
Instead, his legal team has focused on the death sentences imposed after the jury recommendations.
At a February 2026 hearing before the Florida Supreme Court, Wilson’s attorneys indicated that they intended to continue pursuing the issue, potentially taking the challenge to the U.S. Supreme Court.
NO EXECUTION DATE HAS BEEN SET FOR WILSON
Despite the renewed attention surrounding his case, there is no verified execution date for Wade Wilson at this time.
Florida law provides that the governor sets an execution date after certain legal stays have been lifted or dissolved.
That means Wilson remains on death row while the legal process surrounding his sentence continues.
Florida has carried out numerous executions in 2026, but those cases involve other inmates and should not be confused with Wilson’s status.
THE CASE CONTINUES TO DRAW NATIONAL ATTENTION
Wilson’s case has attracted widespread attention because of the brutality of the crimes, the death sentences and the ongoing legal battle surrounding Florida’s death-penalty rules.
For now, however, the central question is not whether Wilson has received a death sentence — he has.
The question is whether that sentence will ultimately survive the remaining appeals.
